Proposed Amended Local Planning Policy PLN 3.3 - Home Occupations, Home Businesses and Rural Home Businesses (PLN 3.3)

Council at its meeting of May 2020 approved advertising of proposed amendments to PLN 3.3. The proposed amendments address changes made to the City’s Town Planning Scheme No.4 (TPS No.4) by the March 2020 gazettal of Amendment No.97 including:

  • A new Special Rural zone over selected localities formerly under the Rural Living zone; and,
  • A new land use/development of the “rural home business” which is now an ‘A’ (discretionary with advertising) use in the Special Rural, Rural Living and General Rural zones and ‘X’ (not permitted) in all other zones of TPS No.4.

The current PLN 3.3 provides guidance to the City in exercising discretion to approve or refuse home occupation and home business proposals in the Residential, Special Residential, Rural Living and General Rural zones of the City of Armadale Town Planning Scheme No.4 (TPS No.4).  The Policy sets out requirements and matters that are considered in determining home occupation and home business applications.

What are the proposed amendments to PLN 3.3?

The amendments to PLN 3.3 propose to add the Special Rural zone as one of the TPS No.4 zones where the Policy would apply and, add the “rural home business” land use classification and set out requirements and matters that would be considered in determining applications for this land use in the Special Rural, Rural Living and General Rural zones of TPS No.4.

The Policy amendments include a “Rural Home Business Compatibility Table”; a tool to assist the City assess development proposals for “rural home businesses”. The Table scores aspects of development proposals i.e. number of workers, commercial vehicles (including size) and development floor area based on their intensity/scale. Proposals that exceed a particular score may be considered excessive, likely to result in amenity impacts and therefore may not be supported.

The current objectives of PLN 3.3 remain unchanged: to provide for small scale businesses associated with a residence on site that do not compromise local amenity and to facilitate suitable businesses in non-commercial/industrial zones.

Council at its May 2020 meeting also approved minor amendments to nine (9) other local planning policies (LLP) to include reference to the Special Rural zone in the policy provisions so that they would apply to the new Special Rural zone and the Rural Living zone. These amendments were minor and therefore did not require public advertising.

Can I make a submission on the proposed amendments to PLN 3.3?

If you would like to make a submission on the proposal please download and complete Submission Form (link below). Submissions must be in writing, and can be lodged via email to info@armadale.wa.gov.au or posted to the City of Armadale Locked Bag No.2, Armadale 6992. Your submission should include the Policy name, the property affected and your name, address and comments. Submissions must be received by the City on or before the closing date (above).

Following a review of submissions the proposed amended PLN 3.3 will be presented to Council for consideration of adoption at a future Council meeting.

Will submissions be confidential?

The name, address and content of submissions will be presented in a confidential attachment in a report to Council after advertising of the amendment has been completed. The report to Council will also include a ‘Schedule of Submissions’ detailing the number of  submissions, issues raised and the City’s recommendation on the issues. The publically available ‘Schedule of Submissions’ does not identify the name and address of those who made submissions. Under legislation the City is required to forward the details of submissions to the Western Australian Planning Commissions for its consideration and recommendation on the Scheme amendment to the Minister for Transport and Planning. Please note that for a submission to be valid it must include the name and address of the person(s) making the submission and be in writing to the City.
