The City has received an application for the abovementioned proposal, which involves the following:
- A change of use for two of the units in the existing commercial complex at 105 Champion Drive Kelmscott. The complex is located adjacent to the 7-11 outlet on the corner of Gillam Drive and Champion Drive in the City’s Industrial Business zone.

One unit is proposed to be changed from a Recreation – Private (gym) use to a Shop.

The other unit is proposed to be changed from a Showroom to a Restricted Premises (Cloud 9) which is intended to specialise in the sale of smoking implements and hydroponic equipment. The application proposes two staff and 8am to 8pm operating hours seven days per week for the Restricted Premises.
Restricted Premises land uses are defined under the City of Armadale’s Town Planning Scheme No. 4 as “premises used for the sale by retail or wholesale, or the offer for hire, loan or exchange, or the exhibition, display or delivery of:
- Publications that are classified as restricted under the Classification (Publications, Films and Computer Games) Act 1995 (Commonwealth); or
- Materials, compounds, preparations or articles which are used or intended to be used primarily in or in connection with any form of sexual behaviour or activity; or
- Smoking-related implements;”

This application has been advertised for comment as both Shop and Restricted Premises are land uses that are discretionary (A) under Town Planning Scheme No. 4 in the Industrial Business zone, meaning that they require advertising to the public as part of the assessment process.
