Other Rates and Charges Information

Late payment interest

Pursuant to Section 6.51 of the Local Government Act 1995, a late payment interest charge on outstanding rates and charges calculated at the rate of 11 per cent will apply for the year ending 30 June 2012.

The late payment interest charge will apply to all current rates and charges remaining unpaid 35 days from the date of issue of the rate notice. Interest will be calculated and updated daily.

Unpaid rates and charges from previous years, ie rate arrears, will also attract late payment charges, calculated at the rate of 11 per cent, for as long as they remain unpaid.

Recovery of rates

If the amount shown as payable in respect of rates and charges is not paid in full or the first instalment is not paid by the due date, the full amount will become overdue and may be recovered by court action (ie a minor case claim, seizure and sale order goods/land).

There have been a number of changes to the Magistrates Court with the average cost of the minor case claim (ie summons) increasing to approximately $195.

If a minor case claim is issued against you, the default is registered by the Magistrates Court to the credit reporting agencies within Australia where the details are shown for a five year period. This information is accessed for finance/loan applications.

If the City of Armadale commences legal actions then a debt recovery administration fee of $63 will be charged to cover the cost of the preparation and administration of the issuing of the minor case claim, seizure and sale order goods/land.
